Legal Opinion atau Opini Hukum/Pendapat Hukum

 

Dalam bahasa latin disebut dengan Ius Opinio.

Legal opinion adalah istilah yang dikenal dalam sistem hukum Common Law (Anglo Saxon).

Tidak ada definisi yang baku mengenai Legal Opinion di Indonesia. Mengacu pada Black’s Law Dictionary, Edisi VII, Henry Campbell Black, definisi Legal Opinion adalah :

A written document in which an attorney provides his or her understanding of the law as applied to assumed facts. The attorney may be a private attorney or attorney representing the state or other governmental antity”. A party may entitled to rely on a legal opinion, depending on factors such as the identity of the parties to whom the opinion was addressed and the law governing these opinion”.

CV Hikmahanto Juwana

Hikmahanto Juwana is a Professor of Law at the Faculty of Law Universitas Indonesia, where he has lectured since 1988. Since then he has been regularly invited to teach at various universities, both in Indonesia and abroad. He specialized in International Law, Indonesian Business Law, Arbitration Law, Competition Law, Contract Law and Mining Law.

Hikmahanto earned his LL.B from the Faculty of Law Universitas Indonesia (1987), LL.M from Keio University, Japan (1992) and Ph.D from University of Nottingham, UK (1997).

He is experienced in various legal works. He has practiced as a lawyer at OC Kaligis & Associates, a top litigation firm based in Jakarta, and Lubis Ganie Surowidjojo, a top non-litigation firm based in Jakarta. He has also served the Government, where he was Senior Legal Advisor at the office of the Coordinating Minister for Economic Affairs. He has also experienced being as administrator at the University when he was appointed as Dean at the Faculty of Law Universitas Indonesia (2004-
2008).

In assiting the Government, Hikmahanto serves as non-permanent advisors to various ministers, inclunding Attorney General Office, Minister of Defense, Minister of Energy and Mineral Resources, Minister of Trade, Minister of Foreign Affairs. He is also a regular resource person for the House of People’s Representative (DPR) and the House of Regional Representative (DPD).

Hikmahanto writes extensively on wide variety of legal issues in his area of specialization, and his works are published in many academic journal as well as mass media.

He is frequently invited as speaker at various national and international seminars and workshops.
